Terms of Service — Velthian

These Terms of Service ("Terms") govern your access to and use of the Velthian platform operated by Velthian Technologies Private Limited, a company incorporated under the Companies Act, 2013 (CIN: U62012HR2026PTC145689) ("Velthian", "we", "us", "our").

By creating an account or using the Service in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the platform.

1. Description of Service

Velthian is a personal wealth tracking and analytics platform that allows individual investors to consolidate, monitor, and analyse their investment portfolio across asset classes including equity, mutual funds, real estate, and fixed income. The platform also provides indicative tax calculations, AI-powered insights, and financial intelligence tools.

Velthian is a tracking and analytics tool only. It is not a SEBI-registered investment adviser, broker, or portfolio manager. Nothing on the platform constitutes investment advice. See our Disclaimer for full details.

2. Eligibility

To use Velthian you must:

Be at least 18 years of age
Be a resident of India or an Indian investor with a valid email address
Have the legal capacity to enter into binding agreements under applicable Indian law

By using the platform, you represent and warrant that you meet these requirements.

3. Account Registration and Security

You must register for an account to access the platform. You agree to provide accurate, current, and complete information during registration and to keep it updated.

You are solely responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must notify us immediately at hello@velthian.com if you suspect any unauthorised access to your account.

We reserve the right to suspend or terminate accounts that show signs of unauthorised access or breach of these Terms.

4. Subscriptions and Billing

Velthian offers both free and paid subscription tiers. Paid plans are billed as described on the Pricing page at the time of purchase.

Billing: Subscription fees are charged in advance for the billing period selected (monthly or annual)
Renewals: Subscriptions renew automatically unless cancelled before the renewal date
Refunds: Fees are non-refundable except where required by applicable Indian law
Price changes: We will give at least 30 days' notice before changing subscription prices

5. Acceptable Use

You agree not to:

Use the platform for any unlawful purpose or in violation of applicable Indian law
Attempt to gain unauthorised access to any part of the platform or its underlying systems
Scrape, crawl, or extract data from the platform by automated means without our written consent
Upload or transmit any malicious code, virus, or disruptive content
Impersonate any person or entity or misrepresent your affiliation
Use the platform to provide financial advice to third parties on a commercial basis
Resell or commercially exploit any part of the platform without authorisation

6. Your Data

You retain ownership of all financial and personal data you enter into the platform. By using Velthian, you grant us a limited, non-exclusive licence to store and process your data solely for the purpose of providing the Service to you.

We do not sell your data. Our full data practices are set out in our Privacy Policy.

7. Intellectual Property

All content, design, software, trademarks, and intellectual property on the Velthian platform — including the name "Velthian", the platform interface, and proprietary analytics — are owned by Velthian Technologies Private Limited or its licensors.

Nothing in these Terms grants you any right to use our intellectual property beyond what is necessary to use the Service as intended.

8. Third-Party Services

Velthian integrates with or displays data from third-party providers (e.g. market data feeds, AI services). We do not warrant the accuracy or availability of third-party data and are not responsible for any loss arising from errors or interruptions in third-party services.

9. Disclaimers

The platform is provided on an "as is" and "as available" basis. To the maximum extent permitted by applicable law, we disclaim all warranties — express or implied — including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement.

We do not warrant that the platform will be uninterrupted, error-free, or free from harmful components. All financial figures, tax calculations, and portfolio valuations are indicative only and should not be relied upon without independent verification.

10. Limitation of Liability

To the fullest extent permitted under the laws of India, Velthian Technologies Private Limited, its directors, employees, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages — including loss of profits, data, or investment returns — arising from your use of or inability to use the platform.

Our total aggregate liability for any claim arising under these Terms shall not exceed the subscription fees you paid to us in the three months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Velthian Technologies Private Limited and its directors, officers, and employees from any claims, losses, or damages (including legal fees) arising from your breach of these Terms or your misuse of the platform.

12. Termination

You may close your account at any time by contacting us at hello@velthian.com. We will delete your personal data within 30 days, subject to legal retention obligations.

We reserve the right to suspend or terminate your account at any time for breach of these Terms, with or without notice. Clauses 7, 9, 10, 11, and 13 survive termination.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Haryana, India.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the platform at least 14 days before they take effect. Your continued use of the platform after that date constitutes acceptance of the revised Terms.
